ORDER SCHEDULING

SETTLEMENT CONFERENCE

AND HEARING

          A telephone conference was held on November 3, 2003.  Michael J. Tostengard, Assistant Attorney General, 445 Minnesota St., Suite 1400, St. Paul, MN 55101-2131, appeared on behalf of the Department of Commerce.  Mary R. Vasaly, Maslon, Edelman, Borman & Brand, 90 South Seventh St., Suite 3300, Minneapolis, MN 55402-4140, appeared on behalf of JMIC Life Insurance Company.

          The parties have notified counsel that their efforts to settle this matter have not been successful.  Counsel are in agreement that a settlement conference may be useful.  In the event that the settlement conference is not successful, the parties jointly request that the matter be set on for hearing. 

IT IS HEREBY ORDERED:

1.                A Settlement Conference shall be held at the Office of Administrative Hearings on December 9, 2003, commencing at 9:30 a.m. Parties shall be prepared to participate in meaningful settlement discussions and have the authority to reach an agreement.

2.                In the event that no settlement is reached, the hearing in this matter shall be held on January 14, 2004, commencing at 9:30 a.m. at the Office of Administrative Hearings, 100 Washington Avenue South, Suite 1700, Minneapolis, MN 55401.  The hearing shall continue on January 15, 2004, if necessary.

3.                Any modifications to the written exhibit and witness lists, including disclosure of expert witnesses, previously filed with the Office of Administrative Hearings, shall be exchanged and filed by January 7, 2004.  Any party objecting to foundation for any written exhibit must notify the offering party and judge in writing at least two working days prior to the hearing or the foundation objection is waived.

4.                In the event that either side requests a court reporter, or an accommodation for disability, notice shall be given to the Office of Administrative Hearings no later than January 7, 2003.
