During the prehearing conference, the
Respondent expressed interest in a settlement conference or mediation session
prior to the hearing. Counsel for the
Department indicated that he would discuss the request with Department
representatives. It is requested that he
notify Mr. Sherayzen and me by May 14, 2010, if the
Department joins in the request. Finally,
the Department will submit a response to the Respondent’s pending Motion for
More Definite Statement within ten days of its receipt of the Motion.
Please do not hesitate to contact my office if you believe that an additional prehearing conference or telephone conference call would be helpful prior to the hearing.
Sincerely,
s/Barbara L. Neilson
