FOURTH PREHEARING ORDER

This matter came before Administrative Law Judge Eric L. Lipman upon the submissions of the parties and their joint request for an adjustment of the deadlines set forth in the Third Prehearing Order;

IT IS HEREBY ORDERED:

1. An evidentiary hearing now scheduled in this matter for Wednesday, January 21, 2009, is cancelled.

2. The parties shall report the status of their settlement accord at the earliest one of the following dates:

a. The day on which a settlement accord has been finalized;

b. The day on which the oral settlement agreement between the parties has been disavowed by a party; or, if neither (a) or (b) has occurred;

c. Friday, March 20, 2009 at 1:00 p.m., in a telephone status conference.
