PROTECTIVE ORDER
Respondent,
Howard F. Thoms, R.N., wants the Board of Nursing to consider his forensic
evaluation report, dated May 22, 2001, when considering mitigating
circumstances for his disciplinary proceedings. The forensic evaluation report was a referral by the Honorable
Andrew Danielson for a psychological evaluation done by Linda Berberoglu,
Ph.D., LP.
The
Respondent, through his counsel, Philip G. Villaume, 5200 Wilson Road, Suite
150, Edina, MN 55424, requests a Protective Order to assure the confidentiality
of the report. Ruth E. Flynn, Assistant
Attorney General, 445 Minnesota Street, Suite 1400, St. Paul, MN 55101-2131,
counsel for the Nursing Review Panel, has no objection to issuance of a
Protective Order.
IT IS HEREBY ORDERED:
The
forensic evaluation report is confidential and shall be sealed for the
record. It shall be available only to
the parties to this proceeding, the administrative law judge, and to the Board
and its staff, as necessary to render a decision, and subject to judicial
review.
