SECOND PRE-HEARING ORDER

This matter came before Administrative Law Judge Eric L. Lipman upon the stipulation of counsel.

Steven M. Gunn, Deputy Attorney General, appeared on behalf of the Minnesota Board of Medical Practice Complaint Review Committee (“Committee”). Morgan Smith, Smith & Raver, LLP, appeared on behalf of the Licensee S.R.P.

Based upon the submissions of the parties, the deadlines of the First Pre-Hearing Order are modified as set forth below.

IT IS HEREBY ORDERED:

1. By 4:30 p.m. on Tuesday, January 11, 2011, the Licensee, Dr. P., shall file and serve his response to the Committee’s motion.

2. By 4:30 p.m. on Tuesday, January 18, 2011, the Committee shall file and serve any reply in support of its Motion for Summary Disposition.

3. An oral argument will be held on the Committee’s motion at the Saint Paul office of the Office of Administrative Hearings on Tuesday, January 25, 2011, beginning at 10:00 a.m.

4. Counsel may appear at the oral argument by way of telephone conference call provided that they file the land-line telephone number at which they may be reached by 12:00 Noon on Monday, January 24, 2011.
