ORDER CERTIFYING MOTION AND CONTINUING HEARING DATE |
On August 16, 2002, the undersigned Administrative Law Judge granted the Complaint Panel’s Motion for Partial Summary Disposition on the allegations of fee splitting and use of runners. There were other allegations which were not the subject of the Panel’s Motion which the Administrative Law Judge set on for hearing beginning on September 9, 2002.
On August 27, 2002, the Complaint Panel and Dr. Pietsch moved for an order certifying the partial summary disposition matter to the full Board. Coupled with that request was a motion for a continuance on the remaining issues pending the Board’s decision on the certified motion.
Based upon all the files and proceedings herein, and upon the standards set forth in Minn. Rule pt. 1400.7600, the Administrative Law Judge makes the following:
1. That the Order on Motion for Partial Summary Disposition dated August 16, 2002, be CERTIFIED to the Minnesota Board of Chiropractic Examiners for their review and action.
2. That the evidentiary hearing scheduled for September 9, 2002, be continued until the Board has acted on the certified matter.

The Administrative Law Judge does not have an adequate basis to make any recommendation to the Board concerning what penalty would be appropriate should the Board agree with the summary disposition. The Administrative Law Judge has forwarded, to the Board, the record available to him when he made his Order on the Complaint Panel’s Motion for Partial Summary Disposition. It is up to the Board to determine what further proceedings, if any, it desires to conduct prior to making it’s decision.
