Dear Ms. Frokjer:

 

At the start of the July 21, 2010, hearing in this matter, I asked the people in attendance if they had had an opportunity to resolve the case.  They said that they had not, but were willing to try.  I asked them to do so.  In about an hour they reached a tentative agreement.  I was notified later in the day that the agreement had been finalized and that the facility was rescinding the Notice of Discharge to J.C.

 

The people involved in the discussions were J.C., the Resident; Philip Lord, Administrator; Wendy Weidner, Regional Ombudsman; Cheryl Anderson, Social Worker; and Julie Smrekar, RN, Case Management Supervisor with U-Care.  The settlement appears to be reasonable for all parties.

 

Based upon the settlement and rescission, I recommend that this matter be dismissed.
