In the Matter of a Nonforgivable Administrative Penalty Order Issued to the Minneapolis Golf Club

PREHEARING ORDER

          A prehearing conference was held on February 13, 2008, at the Office of Administrative Hearings, 600 North Robert Street, St. Paul, MN.  Kristi Nielsen, Assistant Attorney General, 1200 NCL Tower, 445 Minnesota Street, St. Paul, MN 55101-2130, appeared on behalf of the Department of Health (Department).  Daniel A. Haws, Murnane Brandt, 30 East 7th Street, Suite 3200, St. Paul, MN 55101, appeared on behalf of Minneapolis Golf Club (Respondent).

          The Department issued an Administrative Penalty Order (APO) on December 19, 2007.  On January 14, 2008, the Department received a timely request from the Respondent for a contested case hearing.  The Respondent proposed Corrective Actions, and the Department has not accepted those proposals.  The parties agree that the issues concerning the initial APO and the Corrective Actions will be combined for hearing to the extent that they have not been fully resolved.  The parties will conduct discovery and may retain expert witnesses and have agreed to extend the time for hearing.

IT IS HEREBY ORDERED:

1.                Discovery shall be completed by June 30, 2008.

2.                A telephone conference will be held on April 23, 2008, at 1:30 p.m., to review the status of discovery, determine if the discovery deadline should be extended, and set the matter for hearing.  The Administrative Law Judge will initiate the call.

3.                This case may be appropriate for mediation.  The parties are encouraged to consider requesting the Chief Administrative Law Judge to assign a mediator so that mediation can be scheduled promptly.
