Dr. David L. Parker, Petitioner,   vs.   Minnesota Department of Health, Respondent.

ORDER OF DISMISSAL

            On February 19, 2002, Dr Davis L. Parker filed an appeal of his suspension by the Minnesota Department of Health.  The appeal was based on Minn. Stat. § 43A.33 (2000), which provides an appeal process for certain disciplinary actions taken against state employees.

            The parties then requested time to negotiate their differences.  The statute encourages settlements of such disputes.

 

On September 9, 2002, the parties filed a fully executed Settlement Agreement.  The Settlement Agreement provides, inter alia, for the dismissal of the appeal, with prejudice.

Based on all the files and proceedings herein, and pursuant to the authoriy of Minn. Stat. § 43A.33, subd. 4 (2000), the Administrative Law Judge makes the following:

ORDER

That the Appeal of Dr. David L. Parker filed with the Chief Administrative Law Judge by letter of February 19, 2002, be DISMISSED, with prejudice.
