SECOND
PREHEARING ORDER |
A conference telephone call was held on September 20, 2000 between the Administrative Law Judge, Ms. Kinsella and Mr. Knaak.
Based on the representation that the parties are making good faith efforts to settle this matter so as to avoid the need for a hearing, the Administrative Law Judge makes the following:
1. That Mr. Knaak shall provide the letter mentioned in paragraph 1 of the First Prehearing Order no later than October 6, 2000.
2. That dispositive motions referred to in paragraph 3 of the First Prehearing Order shall be due on November 3. Responses shall be due on or before December 8.

MEMORANDUM
The Administrative Law Judge indicated during the September 20 telephone conference that extensions granted herein were based on representations that the parties are making good faith efforts to settle the matter, and were not solely for the purposes of delay. In addition, he indicated that he did not foresee granting any additional extensions. The parties and their counsel are therefore on notice that if this matter is going to be resolved without additional time and expense, it must be done promptly.
