FIRST PREHEARING ORDER

A prehearing conference was held by a telephone conference call on November 15, 1999. Thomas C. Baudler, Attorney at Law, Baudler, Baudler, Maus & Blahnik, 108 North Main Street, Austin, Minnesota 55912-3496, appeared on behalf of the Respondent, Mapleview Firefighters’ Relief Association. E. Joseph Newton, Assistant Attorney General, 525 Park Street, Suite 200, St. Paul, Minnesota 55103-2106, appeared on behalf of the Gambling Control Board.

Based upon discussions with counsel, IT IS HEREBY ORDERED as follows:

1. By December 3, 1999, the counsel for the Gambling Control Board shall disclose to Respondent’s attorney any expert witnesses he intends to call at the contested case hearing.

2. All discovery in this matter shall be completed by January 6, 2000.

3. All dispositive motions in this matter must be filed with the Administrative Law Judge by January 20, 2000.

4. Responses to any dispositive motions must be filed with the Administrative Law Judge by February 3, 2000.

5. If no dispositive motions are brought, counsel shall exchange proposed exhibit lists and notify the Administrative Law Judge about the need for a court reporter by February 3, 2000.

6. The Administrative Law Judge shall hear any dispositive motions on Thursday, February 10, 2000 at 9:30 a.m. in the courtrooms of the Office of Administrative Hearings, Suite 1700, 100 Washington Square, Minneapolis, Minnesota 55401-2138.

7. If no dispositive motions are brought, the contested case hearing in this matter shall commence at 9:30 a.m. on Thursday, February 10, 2000, in the courtrooms of the Office of Administrative Hearings.
