Dear Parties and Counsel:
This letter will confirm the decisions reached at the prehearing conference on August 5, 2005.
1. The hearing in this matter will be held on Tuesday, November 15, 2005, beginning at 10:00 a.m. and continue through November 18, 2005, as needed.

4. The parties will prepare stipulations as to facts and submit them to the judge on or before November 7, 2005.
5. There will be no final oral argument at the hearing. The parties will submit post-hearing letter briefs on December 16, 2005.
6. Reply briefs will be submitted by January 6, 2006.
7. The parties have agreed to a division of the hearing costs. The parties will divide the hearing costs, exclusive of attorneys, witness or expert fees and litigant’s trial preparation and expenses, equally.
8. Township exhibits will be marked with letters. City exhibits will be marked by number.
9. Disclosure of experts and a general description of the subject matter of their testimony shall be exchanged by October 1, 2005.
10. A supplemental list of any rebuttal experts must be disclosed by October 15, 2005.
11. Discovery shall be completed by October 31, 2005.
12. Witness lists, exhibit lists, exhibits to be introduced at hearing, and expert reports must be exchanged and filed with the ALJ before 4:30 p.m. on Monday, November 7, 2005.
13. A copy of the exhibits should also be available for witnesses at the hearing.
14. Ms. Scotillo and Mr. Hood will accomplish republication of the notice of hearing.
