Dear Parties and Counsel:
This letter will confirm the decisions reached at the prehearing conference on December 12, 2005.
1. The hearing in this matter will be held on Tuesday, February 21, 2006 and continuing on the following two days, if necessary, beginning at 9:00 a.m. each day.
2. In accordance with the provisions of Minn. Stat. § 414.09, subd.1(b), for the convenience of the parties, the hearing will be held in a courtroom at the Office of Administrative Hearings, 100 Washington Ave. S., Suite 1700, Minneapolis, Minnesota.
3. The hearing will be tape-recorded and no transcript has been ordered.
4. The parties will prepare stipulations as to facts and submit them to the judge on or before February 6, 2006.

5. There will be no final oral argument at the hearing. The parties will submit post-hearing letter briefs on a schedule to be determined at the hearing.
6. The parties have not agreed to a division of the hearing costs. The parties will submit proposals regarding the division of costs on a schedule to be determined at the conclusion of the hearing.
7. Petitioner’s exhibits, including those of the City of Vadnais Heights, will be marked with letters. Exhibits of the City of Gem Lake will be marked by number.
8. Final witness lists must be exchanged and filed with the ALJ before 4:30 p.m. on February 13, 2006.
9. All written exhibits must be exchanged and filed with the ALJ before 4:30 p.m. on February 13, 2006. A copy of the exhibits should also be available for witnesses at the hearing.
