ORDER
OF DISMISSAL |
On November 2, 2010, Robyn West filed a Complaint with the Office of Administrative Hearings alleging that Respondents Senate District 51 DFL and Tom Hamilton, Treasurer Senate District 51 DFL, violated Minn. Stat. § 211B.06 by preparing and disseminating false campaign material. On November 3, 2010, Administrative Law Judge Beverly Jones Heydinger determined that the Complaint set forth a prima facie violation of Minn. Stat. § 211B.06. On November 16, 2010, the Chief Administrative Law Judge assigned this matter to a panel of three Administrative Law Judges and scheduled a prehearing conference to occur on December 21, 2010, and an evidentiary hearing to occur on January 4, 2011. Due to scheduling conflicts, by Order dated December 2, 2010, the prehearing conference was rescheduled to January 13, 2011, and the evidentiary hearing was rescheduled to January 19, 2011.
The telephonic prehearing conference occurred on January 13, 2011, and Robyn West, Jeremy Powers, Chair of Senate District 51 DFL, and Tom Hamilton participated without representation. During the prehearing conference on January 13, 2011, West stated her intention to withdraw the Complaint, and she submitted a letter withdrawing the Complaint to the Office of Administrative Hearings that day.[1]
Based upon the Complainant’s withdrawal of the Complaint,
IT IS ORDERED:
That the Complaint filed by Robyn West against Senate District 51 DFL, and Tom Hamilton, Treasurer Senate District 51 DFL, is DISMISSED and the file in this matter is closed.

[1] Minn. Stat. § 211B.36, subd. 2, provides that a complainant may withdraw a complaint any time before an evidentiary hearing.
