ORDER OF DISMISSAL

 

On November 1, 2010, Robyn West filed a Complaint with the Office of Administrative Hearings alleging that Mike Bourke violated Minn. Stat. § 211B.06 by preparing and disseminating false campaign material.  On November 3, 2010, Administrative Law Judge Beverly Jones Heydinger determined that the Complaint set forth a prima facie violation of Minn. Stat. § 211B.06.  On November 5, 2010, a probable cause hearing was conducted by telephone conference call.  By Order dated November 10, 2010, Administrative Law Judge Heydinger found that there was probable cause to believe that Respondent violated Minn. Stat. § 211B.06.  On November 15, 2010, the Chief Administrative Law Judge assigned the matter to a panel of three Administrative Law Judges and scheduled an evidentiary hearing to occur on November 24, 2010.  Due to scheduling conflicts, by Order dated November 24, 2010, the evidentiary hearing was rescheduled to January 5, 2011. 

On December 31, 2010, Ms. West notified the Office of Administrative Hearings that the parties had settled the matter.  On January 12, 2011, the Office of Administrative Hearings received the parties’ Stipulation for Dismissal of Complaint in which Ms. West withdrew the Complaint against Mr. Bourke.[1]

          Based upon the Complainant’s withdrawal of the Complaint, IT IS ORDERED:

          That the Complaint filed by Robyn West against Mike Bourke is DISMISSED and the file in this matter is closed.

[1] Minn. Stat. § 211B.36, subd. 2, provides that a complainant may withdraw a complaint any time before an evidentiary hearing.
