ORDER DISMISSING COMPLAINT |
The above-entitled matter came on for a probable cause hearing as provided by Minn. Stat. § 211B.34, before Administrative Law Judge Manuel J. Cervantes, on September 17, 2010, to consider the complaint filed with the Office of Administrative Hearings on September 13, 2010, by the Complainant, Bruce Sanders. The Respondent, Alan Williams, submitted a response and additional information by electronic mail on the morning of September 17, 2010 which was considered in the probable cause hearing. The parties participated by telephone conference call. The record closed upon the conclusion of the conference call on September 17, 2010. The Complainant and the Respondent each appeared on his own behalf.
On September 20, 2010, the Complainant sent an email indicating that he sought the dismissal of the Complaint, without prejudice.
Based upon the record and all of the proceedings in this matter, including the Memorandum incorporated herein, the Administrative Law Judge makes the following:
ORDER
IT IS HEREBY ORDERED:
That this matter is DISMISSED, without prejudice to refiling of the complaint.
