Dear Ms. Forney and Mr. Smith:

This letter will document the matters discussed during our telephone prehearing conference yesterday, and constitutes the First Prehearing Order in this case.

1.                        By 4:30 p.m. on Wednesday, January 13, 2010, each party will file with the Office of Administrative Hearings and serve on each other copies of pre-marked exhibits that they propose to offer into the hearing record.  Ms. Forney shall label her exhibits sequentially using numbers 1 through 50.  Mr. Bourn shall label his exhibits sequentially using the numbers 51-100.  The parties shall serve one copy of their exhibits on each other and shall file three copies of their exhibits and an exhibit list with the OAH.

2.                        By 4:30 p.m. on Wednesday, January 13, 2010, each party shall file with the Office of Administrative Hearings and serve on each other a list of the witnesses that they intend to call at the evidentiary hearing along with a brief summary of the expected testimony of each witness.

3.                        The parties are encouraged to enter into a stipulation of facts, to the extent possible.  Any such stipulation may be filed with the OAH in advance of the hearing or stated on the record at the start of the hearing. 

4.                        The evidentiary hearing has been rescheduled to be held at the Office of Administrative Hearings beginning at 9:30 a.m. on Wednesday, January 20, 2010.  The hearing shall continue on Thursday, January 21, 2010, if necessary.  The hearing will take place before a panel of three Administrative Law Judges in a courtroom on the first floor of the OAH, located at 600 North Robert Street, in St. Paul, Minnesota.  The hearing will be digitally recorded.  No transcript has been ordered at this time.
