ORDER JOINING  RELATED COMPLAINTS

TO:  Parties

On September 13, 2004, Mr. Don Fuller filed two complaints with the Office of Administrative Hearings alleging violations of Minn. Stat. § 211B.06 by Minnesota Supreme Court Associate Justice Alan Page and Marc Kaplan, Treasurer, Alan Page for Justice Re-election Committee.  Both complaints allege the creation, publication and dissemination of false campaign material related to Justice Alan Page.

Pursuant to Minn. Stat. § 211B.33, subd. 4, the Chief Administrative Law Judge may direct that two or more complaints be joined for disposition if the allegations in each complaint are of the same or similar character, or are based on the same act or failure to act.

After reviewing the complaints, the Chief Administrative Law Judge has determined that the allegations set forth in the complaints are of the same or similar character and are based on the same acts. 

          THEREFORE, IT IS HEREBY ORDERED:

That the complaints filed by Don Fuller against Justice Alan Page and Marc Kaplan be joined for disposition as OAH file number 1-0320-16155-CV.
