Dear Counsel:
This letter constitutes the Second Prehearing Order concerning matters discussed in our prehearing telephone conference yesterday afternoon. Mr. Haines appeared for the County; Ms. Appelhof appeared for Ms. Fiecke. Mr. Haines requested a continuance of the hearing scheduled for March 6, 2007, so that he could have time to select the necessary exhibits from the large file now covered by the Protective Order in this matter. Ms. Appelhof opposed the motion, citing her client’s concern for resolving this matter expeditiously and the fact that a psychologist had reserved time on March 6 to testify on behalf of Ms. Fiecke.
The Administrative Law finds that there is good cause for a short continuance of the hearing based on (1) the limited time between the issuance of the Order on Motion for Summary Disposition and the scheduled hearing, which did not allow much time for either side to prepare; (2) the likelihood that a short continuance will result in a better organized and more efficient hearing; and (3) Mr. Haines’ agreement that the psychologist may provide testimony by telephone during the hearing and thus avoid the time, inconvenience, and possible expense involved in appearing personally.
Accordingly, the hearing will now take place at 9:30 a.m. on March 21, 2007. Please exchange your exhibits and witness lists by March 14, 2007.
