In the Matter of the Appeal of the Determination of the Responsible Authority for the Minnesota Department of Administration that certain data about Teresa M. Graham in Advisory Opinions 01-031 and 01-034 are accurate and/or complete.

PREHEARING ORDER

 

 

          The above matter is pending before the undersigned Administrative Law Judge pursuant to a Notice of and Order for Hearing dated May 21, 2001.  The Notice sets the hearing date as August 1, 2001.

 

          Amy Kvalseth, Assistant Attorney General, 525 Park Street, Suite 200, St. Paul, MN 55103-2106, represents the Respondent, the Commissioner of Administration.  Teresa M. Graham, 4837 Ewing Avenue South, Minneapolis, MN 55410, the Appellant, represents herself.

 

          On or before July 9, 2001, each party must file a prehearing statement with the Administrative Law Judge and serve it on the other party.  The statement must contain:

 

1.               The names and addresses of all witnesses that the party intends to call at the hearing, along with a brief summary of each witnesses testimony and an estimate of the length of the testimony.

2.               A brief statement of the issue(s) that must be resolved at the hearing.

3.               A brief description of each written exhibit to be offered at the hearing.  (three copies of each exhibit must be available at the hearing.)  Respondent’s exhibits must be numbered (1, 2, 3…) and the Appellant’s exhibits must be lettered (A, B, C…).

 

The parties are advised that all testimony and exhibits must be relevant to the matters set out in the Notice of and Order for Hearing.

 

The hearing will be conducted under the Professional Aspirations adopted by the Minnesota Supreme Court.  A copy is enclosed.

 

          The hearing will be tape-recorded.  No transcript will be prepared unless requested and paid for by a party. 

 

          A failure to comply with this Order will result in a recommendation for dismissal of this proceeding.
